Terms of Use

1. Agreement Overview

 

These Terms of Use ("Terms") constitute a legally binding agreement between TributeTunes ("we", "us", or "our") and you ("User", "you", or "your"). By using our services, whether through creating an account or as a guest, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our services.

 

2. Changes to Terms

 

TributeTunes reserves the right to update, change, or replace any part of these Terms at any time. Changes will be effective immediately upon posting to the website at www.tributetunes.com/terms. It is your responsibility to check for updates periodically. Your continued use of our service following the posting of any changes constitutes acceptance of those changes.

 

3. User Account

 

 

  • Creation: To access certain features of TributeTunes, you must register for an account. You agree to provide accurate information as outlined in our Privacy Policy and maintain the security of your account.

  • Use: Accounts are for personal, non-commercial use only. Activities like reselling, deep-linking, scraping, or using data mining tools are prohibited.

  • Termination: You can terminate your account by sending a cancellation request to info@tributetunes.com, which will be processed within 30 days. TributeTunes may suspend or terminate your account at any time without notice or liability.

  • User Content Responsibility: You represent and warrant that you have obtained all necessary rights, permissions, and consents from any individuals whose names, likenesses, personal information, or stories are included in content you submit to the Service. You agree not to submit any content that is unlawful, defamatory, infringing, misleading, or violates the privacy or rights of any third party.

  • License to Use Submitted Content: By submitting content to the Service, you grant TributeTunes a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process such content solely for the purpose of providing and improving the Service.

 

 

4. User Eligibility

 

You must be at least 18 years old or the age of majority in your jurisdiction to use our services, as per our Privacy Policy regarding children's privacy.

 

5. Service Description

 

TributeTunes provides a platform for users to create personalized songs based on details provided by customers. Each song ("Tune") is generated using advanced automated synthesis technology. By using the Service, you acknowledge that the creative output is produced by algorithmic processes and may include variations or digital artifacts inherent to automated systems. Each song ("Tune") is tailored for personal use and delivered via email and online links (e.g., third-party cloud storage providers such as Google Drive). These links are accessible to anyone who has the link, and TributeTunes does not control how recipients may share or distribute them. Customers are responsible for managing access to their purchased songs.

You acknowledge that all Tunes are generated through automated processes and may include fictionalized, approximate, or interpretive elements. Outputs may contain inaccuracies, unintended similarities to existing works, or content that may not align with your expectations. TributeTunes does not guarantee factual accuracy, originality, or suitability for any particular purpose.

TributeTunes reserves the right, but not the obligation, to refuse, modify, or discontinue processing any request or submitted content that we determine, in our sole discretion, may violate these Terms, applicable laws, or create legal or reputational risk.

The Service is intended for personal entertainment purposes only and is not designed for professional, legal, or commercial use cases.

 

6. Purchasing and Orders

 

 

  • Ordering Tunes: You can select from various tones and genres to customize your Tune. Once an order is placed, changes are not permitted.

  • No Refunds: All sales are final unless otherwise specified by TributeTunes at our discretion.

  • Song Links: Song links are stored for a minimum of 90 days after delivery. TributeTunes does not guarantee permanent storage and reserves the right to remove links after this period. It is the customer’s responsibility to download and back up their purchased song before the expiration date. If you require access to a song beyond 90 days, please contact us at info@tributetunes.com, though continued availability is not guaranteed.

 

 

7. Intellectual Property

 

All Tunes and related materials are the property of TributeTunes and our artists. You acknowledge that the Tunes are created via computational synthesis. Under current legal standards, algorithmically generated content may have limited or no eligibility for traditional copyright protection. You receive a non-exclusive, non-transferable license to use the Tune for personal, non-commercial purposes only. While you may share your purchased song privately with friends and family, you may not publicly distribute, resell, or make it available on public platforms (e.g., YouTube, social media, file-sharing sites) without explicit permission from TributeTunes.

You acknowledge that due to the nature of automated generation systems, similar or identical outputs may be created for other users. TributeTunes does not guarantee exclusivity or uniqueness of any Tune.

This restriction includes, without limitation, use in advertising, branded content, monetized media, public performances, or any commercial or business-related activity without prior written consent from TributeTunes.

 

8. Payment

 

 

  • Pricing: Prices are listed on the order page, and payment is required at the time of order.

  • Currency: All transactions are in USD, and any conversion fees from other currencies are your responsibility.

  • Payment Methods: We accept major credit cards and other payment platforms as we may determine. Payment details are processed securely as outlined in our Privacy Policy.

 

 

9. Gift Cards

  • Availability: Gift cards are digital and can only be used for purchases on our platform.

  • Use: They are subject to terms regarding balance, expiration, and usage restrictions.

 

 

10. Perfect Note Guarantee

TributeTunes offers the Perfect Note Guarantee to ensure your song meets the quality and customization standards described at the time of purchase. While revisions are generally not required, if something doesn’t feel right, you may contact us within 24 hours of delivery at info@tributetunes.com, and we will make reasonable adjustments at our discretion. This 24-hour window represents the full extent of our satisfaction guarantee. This guarantee does not extend to unauthorized sharing, redistribution, or any use of the song outside the terms outlined in Section 7 (Intellectual Property).

 

11. Privacy

 

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. Please review it at www.tributetunes.com/privacy-policy

 

12. Limitations of Liability

TributeTunes provides its service 'as is' without warranties of any kind. We are not liable for any content generated by our automated systems that you may find inaccurate or unsatisfactory. We do not warrant that the algorithmically generated output will not inadvertently resemble existing musical works, and TributeTunes is not responsible for any third-party claims of infringement arising from the generated content. We are not liable for any indirect, incidental, special, or consequential damages from your use or inability to use our services. Songs are hosted and delivered through third-party file-sharing services (e.g., third-party cloud storage providers such as Google Drive), which are subject to their own terms and policies. TributeTunes is not responsible for unauthorized access, sharing, or availability issues due to third-party service disruptions.

TributeTunes relies on third-party technology providers to process and generate content. These providers operate under their own terms and policies, and TributeTunes is not responsible for their performance, data handling practices, or any resulting output, errors, or service interruptions.

TributeTunes is not responsible for any emotional, personal, or subjective interpretation of the generated content, including content created for sensitive occasions.

TributeTunes is not responsible for the retention, storage, or use of submitted content by third-party providers operating under their own systems and policies.

TributeTunes is not responsible for any loss, deletion, or failure to store or retrieve content, including purchased Tunes, whether due to third-party services, technical issues, or expiration of storage periods.

 

​13. Copyright Complaints

If you believe that any content generated through the Service infringes your copyright or other intellectual property rights, please submit a notice to info@tributetunes.com

Including:

(a) a description of the copyrighted work claimed to be infringed;
(b) a description of the allegedly infringing material;
(c) your contact information;
(d) a statement that you have a good faith belief that the use is not authorized; and
(e) a statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the rights holder.

 

Submission of a notice does not constitute legal service of process or formal legal notice.

14. Indemnity

You agree to indemnify, defend, and hold harmless TributeTunes, its affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

(a) content you submit;
(b) your use of the Service;
(c) your violation of these Terms; or
(d) your violation of any rights of a third party.

 

15. Dispute Resolution

Any disputes under these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, not in court, except where explicitly stated otherwise. You agree that any disputes will be resolved on an individual basis and waive any right to participate in a class action or representative proceeding.

 

16. Governing Law

​

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.
 

17. Force Majeure

​

TributeTunes shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to technical failures, third-party service disruptions, natural disasters, or acts of government.

 

18. Miscellaneous

 

  • Severability: If any part of these Terms is found invalid, the remainder will still apply.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our consent.

  • Entire Agreement: These Terms constitute the entire agreement between you and TributeTunes regarding the use of the Service and supersede any prior agreements or understandings.

  • No Waiver: Failure by TributeTunes to enforce any provision of these Terms shall not be considered a waiver of that provision.
